Aventis CropScience USA LP and an independent researcher, Norma Trolinder, are suing Monsanto Company for patent infringement covering transgenic cotton and claims that Monsanto is exploiting the patents to exclude competition. The lawsuit alleges that Monsanto's patents failed to include Dr. Trolinder as a co-inventor, which would have given her the right to license the patents. Dr. Trolinder and Texas Tech University subsequently transferred their patent rights to Aventis, which will be developing transgenic cotton.
