LONDON (ICIS news)--A joint lawsuit has been filed in the US by Novartis Vaccines and Diagnostics and Novo Nordisc A/S against Bayer alleging the German chemicals company had infringed their patent and they were claiming compensation, it said on Wednesday.

It would vigorously defend itself against the complaint, which was filed in a federal court in Marshall, Texas, Bayer said.

“The plaintiffs allege that through production and distribution of the recombinant factor VIII product Kogenate the company infringes a compound patent issued in 2006,” the company added.

Sales of haemophilia treatment Kogenate were €213m ($313m) for third quarter of 2007 and the drug was the company’s third best-selling medicine during the period.

Bayer’s shares were 2.79% down on the news on Xentra to close at €53.37.
