DuPont sues Bemax over contract violations

HOUSTON (ICIS news)--US titanium oxide producer DuPont has sued Bemax Resources Ltd of Australia over alleged violations of contractual obligations, based on a court filing in Wilmington, Delaware.

 

The lawsuit relates to three supply contracts requiring Bemax to provide DuPont with ore materials rutile, leucoxene and secondary ilmenite used to make TiO2. Further details were not available.

 

Bemax’s parent company, pigments maker Cristal will get to take a first look at the sealed court documents, said Amy Drusano, Cristal's manager of corporate communications.

 

"My understanding is that our executive group and our legal team were just seeing everything today," Drusano said.

 

Bemax is one of the world’s largest mineral sands companies and a major TiO2 producer. Cristal had acquired majority control of the company in July 2008.

 

US producers of TiO2 include Cristal, Hunstman, DuPont, Tronox and Kronos.

 

In North America, TiO2 contract prices are from 104-114 cents/lb ($2,293-2,513, €1,628-1,784/tonne) FD (free delivered), according to data from global chemical market intelligence service ICIS pricing http://www.icispricing.com/il_home.asp
