HOUSTON (ICIS news)--US nylon producer Invista said on Thursday that it has filed another lawsuit against Rhodia, accusing the company of stealing trade secrets as part of a plan to build an Asian adiponitrile (ADN) plant with DuPont.
Invista filed the suit in Delaware state court. A Rhodia spokesman said the company was not yet commenting on the suit because it has not seen the complaint.
The company had filed a similar suit in US federal court, accusing both Rhodia and DuPont of using its trade secrets to build the plant. Rhodia and DuPont denied that allegations that Invista made in that earlier suit.
The judge threw out that suit because Invista failed to make any claims that fell under the jurisdiction of the court.
Afterward, Invista amended the federal suit, limiting its accusations to DuPont. The suit Invista filed in Delaware state court targets Rhodia.
“These claims are needed to stop Rhodia and DuPont from unlawfully using Invista’s intellectual property to build an ADN manufacturing plant in Asia or elsewhere,” Invista said in a statement.
ADN is an intermediate used to make nylon 6,6.
DuPont said earlier this week it had filed a lawsuit against Invista over alleged misappropriation of trade secrets and proprietary information relating to DuPont's nylon engineering resins business.
Invista was formed in 2004 after privately owned Koch Industries acquired DuPont’s textiles and interiors business in a $4.4bn (€3.5bn) deal and merged it with its Kosa fibres business.
