HOUSTON (ICIS news)--Lawyers for Dow Chemical asked a judge in Delaware Chancery Court to disqualify the firm representing Rohm and Haas, in a lawsuit over an $18.8bn (€14.7bn) merger, the Associated Press (AP) reported on Wednesday.
The law firm that now represents Rohm and Haas has advised Dow in the past and has maintained a relationship with Dow, the judge was told, according to the news account. As such, the firm could be entangled in an ethical conflict by representing Rohm and Haas.
The firm representing Rohm and Haas - Wachtell, Lipton, Rosen and Katz - said that any information that Dow shared with the lawyers would not significantly affect the Rohm and Haas case, the AP reported. Moreover, Dow cannot prove that such a continuing relationship still exists.
Rohm and Haas sued Dow after the company missed a 27 January deadline to close the merger.
The trial is set for 9 March.
