US court rules in favour of Makhteshim Agan on patent case

SINGAPORE (ICIS)--Israeli fertilizer producer Makhteshim Agan Industries (MAI) said on Wednesday that a US court has ruled in favour of its North American unit on a patent impingement case lodged by German chemical majors BASF and Bayer involving an insecticide product.

BASF and Bayer brought MAI to court in April 2010 over fipronil, an insecticide developed by Makhteshim Agan North America (MANA) and its affiliate, Control Solutions Inc (CSI), MAI said in a statement.

MAI said the court granted a motion for summary judgment.

“We are delighted that the North Carolina Court has ruled in our favour, confirming that our products do not impinge on the patents of any of our competitors,” said Shaul Friedland, region head for Americas at MAI, in the statement.
