HOUSTON (ICIS)--US-based Momentive Specialty Chemicals said on Monday it has made progress in its patent challenge against China’s Hebei Shield Excellence Technology.
Colombus, Ohio-based Momentive filed a patent infringement case last year in China, alleging Hebei Shield was violating one of Momentive’s patents for the production of CARDURA glycidyl ester monomers.
The Jiangsu High Court on 15 June rejected a jurisdictional challenge filed by Hebei Shield contesting the authority of the Suzhou Intermediate People’s Court to preside over the case, Momentive said.
The US-based manufacturer said it also received a favourable ruling from China’s Reexamination Board of the State Intellectual Property Office, which declared invalid a process patent by Hebei Shield for the manufacture of glycidyl esters. Momentive maintained the process was “an obvious modification of a process known in the industry for more than 50 years”.
The CARDURA glycidyl ester monomers are used in the production of specialty coatings such as those used in automotive, civil engineering, industrial, marine, coil and UV-curable coating systems, Momentive said.
