HOUSTON (ICIS)--Mossi & Ghisolfi (M&G) will seek to appeal a US court ruling that it infringed an INVISTA patent, the Italy-based polyethylene terephthalate (PET) major said on Friday.
M&G was responding to news this week that the US District Court in Delaware found that two members of M&G infringed on INVISTA’s PolyShield patent for the protecting the shelf life of oxygen-sensitive food and beverages.
M&G said that the court "indicated that there was indirect infringement on this patent only". M&G will appeal the decision, it said.
The company added that the patent was unique to the US and had no counterpart in any other country.
M&G said that in the US, INVISTA had brought legal action against M&G under three patents, but the claims had been rejected or INVISTA voluntarily dismissed them - with the exception of one, which M&G is appealing. In related cases brought by INVISTA in Germany and Italy, authorities found no infringements on the part of M&G, the company added.
In a statement, INVISTA said ""The court’s rulings and jury verdict speak for themselves. The bottom line is that M&G’s PoliProtect APB and JB resins have been found to infringe multiple claims of a valid US patent."
