CF sued by West, Texas apartment complex over April explosion

HOUSTON (ICIS)--The real estate company that owns the apartment complex destroyed by the massive lethal explosion at West Fertilizer on 17 April filed a lawsuit on Wednesday against fertilizer producer CF Industries.
In the lawsuit, J&B Realty accuses CF of being negligent in designing, manufacturing, marketing and selling the ammonium nitrate present at the retail distributor at the time of the blast due to their failure to use an additive that would have decreased the chances of a serious or fatal explosion.
The realty company asserts that the entire complex was made uninhabitable and can not be rented.
J&B also says several other properties it operates within West, Texas were equally impacted by the explosion, which resulted in 15 fatalities, injured 200 and caused approximately $100m in structural damage to the community.
Federal and state officials have yet to determine the exact cause of the accident despite an extensive and costly investigation.
This is the second lawsuit against CF as the town of West in June filed against the fertilizer producer, accusing the company of not exercising proper care with the shipments of ammonium nitrate and for failing to inspect the West Fertilizer site. The city also said CF made no attempt to determine public risk or add the additives to make the nutrient less combustible.
CF did not immediately respond to a request for comment on the lawsuit.
