RWE and E.ON file lawsuit against Germany's nuclear fuel tax

German nuclear power plant operators E.ON and RWE have filed a legal claim to block nuclear fuel tax on the newly installed rods at their jointly owned 1.3GW Gundremmingen B and 1.3GW Gundremmingen C nuclear reactors.

The lawsuit was filed on Tuesday at a court in Munich, German media reported. While E.ON said on Tuesday that it was proceeding with the legal claim against the tax, RWE said at the time, it would make the decision sometime this week (see EDEM 21 June 2011).

Germany recently decided to phase out all remaining nuclear power by 2022 as part of its energy turnaround package (see EDEM 6 June 2011). As nuclear tax was initially introduced as compensation for the longer nuclear lives, the government's decision to keep the tax despite the nuclear phase-out sparked outrage among nuclear plant operators (see EDEM 6 and 28 September 2010).
